In 2015, the U.S. Supreme Court recognized that gay and lesbian couples should enjoy legal recognition of the legitimacy of their relationships, including domestic partnership and same sex marriages. With this new recognition, LGBT families are facing complex legal issues that include adoption and surrogacy, access and timesharing to children, guardianship, and dependency to name a few.

Same sex couples going through a divorce will face the same issues as other couples. In Florida, a divorce action is called a Dissolution of Marriage. Once a Petition for Dissolution is filed, a Florida state court judge is able to legally end the bonds of matrimony and declare both parties single. The judge will also be able to divide marital assets and debt, any issues involving the marital children, and attorney’s fees.

Florida is a no-fault state, which means that either party is able to file for divorce without having to show that the other party is at fault. A divorce can either be a contested one or uncontested. The divorce is considered to be contested if the parties are not able to agree on the terms of the divorce. These terms may include details of the parenting plan, child support, alimony, division of assets, temporary support, and many more.  An uncontested divorce is where both parties are able to agree on all material issues.

Whether your case is a contested or uncontested case, it is important that you seek legal advice. Elizee Law Firm is experienced in handling both contested and uncontested cases and is focused on safeguarding your rights. Allow the firm to represent you and your family in your pending family law issue.
